Alabama General Bill of Sale

Alabama General Bill of Sale is a legal instrument intended to provide documentary evidence of a sale/purchase transaction of personal property within Alabama State. The document also serves as a receipt for the financial transaction between the seller/s and the buyer/s.

Notarization of the document is mandatory. However, witness signature is necessary only when necessitated by state law. This Form is not suited for real estate transactions. The seller signing the Bill of Sale does not undertake to offer any warranty and sells the item/property as is. Furthermore, the seller indemnifies the buyer from any liabilities, claims, and limitations of whatsoever manner and provides the fullest legal rights to enjoy the property. Provide the date of execution of Bill of Sale. Continue by entering the name/s of the seller/s signature/s, street address, city, state, and zip code. Enter the date on which the document is signed. Furnish similar details along with the signature and date of signature of buyer/s in the respective fields.

The succeeding portion has space for name, address, and signature of the witness if required by the state law. Leave blank otherwise. Continue with Notary Acknowledgement section. Inputs requires here are the name of the county of Alabama State, date, name of the Notary Public, name/s of the parties involved along with the seal and signature of the Notary Public and date of commission expiry.

Further Assurances. Seller hereby warrants that (s)he is the lawful owner of said property and that (s)he has full legal right, power, and authority to sell said property. Seller further warrants said property to be free of all encumbrances, liens, security agreements, claims, demands, and charges of every kind whatsoever and will warrant and defend the title to said property against any and all persons whomsoever.

Any notice, request, instruction or other document to be given under this Bill Of Sale to any party hereunder by any other party hereunder shall be in writing and delivered personally, or sent by registered or certified mail, postage prepaid to the following addresses:

Waiver Of Contractual Right. The failure of either party to enforce any provision of this Bill of Sale shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Bill of Sale.

No Representations. Neither party has made any representations nor promises, other than those contained in this Bill of Sale or in some further writing signed by the party making the representation or promise.

THE DESCRIBED PROPERTY IN THIS BILL OF SALE IS SOLD ON THE UNDERSTANDING AND BASIS OF “AS-IS”CONDITION WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
