District of Kansas Bankruptcy Proof of Claim Form B10 is a legal instrument signed and issued by a creditor to claim money owed by debtor through legal channel. Creditor’s authorized agent, debtor, debtor’s authorized agent, trustee, endorser, surety, co-debtor, and guarantor are authorized to sign and issue this form B10 proof of claim. However, you as signing principal must identify yourself in part 8 of this form. The form has eight parts and your inputs pertaining to bankruptcy amount claim is required in all these eight parts.
Do not enclose any original documents along with the form. You may choose to enclose a stamped and self-addressed envelope for receiving the acknowledgement of the claim. You may choose to sell this claim to third parties; however, Bankruptcy Code (11 U.S.C. § 101 et seq.) and any applicable orders of the bankruptcy court govern such transfer of claim. Form B10 is not suitable for claiming administrative expense during filing of bankruptcy.
Before filing for Bankruptcy in Kansas, you need to fill the Kansas Bankruptcy Proof of Claim Form
Enter the name of debtor, case number, and creditor’s name in respective spaces. Then enter names and addresses for sending notices and payment. You may choose to mark boxes on the right when applicable and provide necessary information like date of filing claim and claim number.
Part I: Enter the amount of claim in part I. Mark the box to indicate that the claim amount includes interest and other charges.
Part II: Refer instruction 2 before entering basis for claim and fill the details accordingly.
Part III: Enter only last four digits of creditor’s government issued ID in part III. Then enter debtor’s scheduled account in 3a and Uniform Claim Identifier on line 3b.
Part IV: Provide details about the Secured Claim like nature of property, value of property, annual interest rate and type, amount of arrearage and other charges, then basis for perfection, amount of secured claim, and unsecured amount on respective lines of part IV of District of Kansas Bankruptcy Proof of Claim Form B10.
Part V: Mention Amount of Claim Entitled to Priority in the space available in part V after selecting the type of claim priority by marking your response. You need to provide relevant paragraph number of section 11 U.S.C. § 507 (a) in case you select the option other.
Part VI: Enter all amounts of payments credited to debtor’s account in part VI of B10, Proof of Claim form.
Part VII: Refer to instruction number 7 and definition of redacted documents and enclose all supporting documents accordingly. You may list these documents in part VII. Please do not enclose any original documents along with this form.
Part VIII: Select your role as a petitioner from the four available options in part VIII. Then enter your printed name and address along with phone number and email address. Complete District of Kansas Bankruptcy Proof of Claim Form B10 by signing on the line available. You must enter the date of signing this legal instrument after your signature.
