Title VI Civil Practice and Procedure, Chapter 83 Landlord and Tenant, and Section 56 of the Florida Statute 2015 has directives for a Landlord to serve Florida Seven-Day Notice for Non-Compliance (With Cure) to a Tenant for non-compliance to the terms of tenancy.
Such notice is immediately served upon the breach of tenancy like keeping pets or structural damage to the property to terminate the tenancy. The Tenant has rights to take remedial actions to cure the breach within the notice period and report the same to the Landlord to continue the tenancy. However, the Landlord reserves the rights to file eviction and recovery suit against the Tenant upon non-compliance after the notice period is over. However, the Landlord must follow the directives mentioned in Chapter 83, Title VI of Florida Statute while proceeding with serving various types of notices and eviction suit.
Before filling the Florida Seven Day Notice
- The Landlord must serve a 7-day notice to vacate to the Tenant in case this breach is the second violation in the period of last twelve months and the Tenant fails to comply to take remedial actions upon serving the Florida Seven-Day Notice for Non-Compliance (With Cure).
- Please specify the nature of breach descriptively and demand the remedial actions in the notice. Please ensure to mention that the tenancy will terminate upon the non-compliance of the Tenant to the suggested remedial actions to cure the breach.
- The Tenant has rights to take remedial action within the notice period of seven business days. Any breach within this period of seven days is not considered as a breach of the tenancy when the Tenant is taking measures to cure the breach.
- The Landlord must maintain the proof of service of the notice served to the Tenant. However, it is not necessary to hand over a copy of proof of service to the Tenant. The Landlord must mention the date, time, and mode of serving the notice in the proof of the service.
- Alternately, you as Landlord have rights granted by Florida Statute to serve Florida Seven-Day Notice for Non-Compliance (Without Cure) on the Tenant in case the breach of the tenancy is serious and irrevocable.
