Some Definitions which you might find useful
“Principal” : An individual who grants authority to an agent in a power of attorney, an individual who wishes to appoint someone else to make decisions on behalf of him.
“Agent” : A person granted authority to act for a principal under a power of attorney also known as “attorney in fact”. The term includes an original agent, co-agent, and successor agent.
“Durable” : The power of attorney is not terminated by the principal’s incapacity. Use the below Durable Power of Attorney Form if you want to allow your agent to continue having the powers even if the principal (you) are incapacitated.
“Incapacity” : The inability of an individual to take those actions necessary to obtain, administer, and dispose of real and personal property, intangible property, business property, benefits, and income.
“Power of attorney” : A writing that grants authority to an agent or attorney-in-fact to act in the place of the principal, whether or not the term is used in that writing.
